Engineers Association Members Social Security Fund Regulation

Article 1: Regulation name and effect

This Regulation shall be cited “Engineers Association Members Social Security Fund Regulation of 2014” and it shall come into force as of the date on which it is published in the official gazette.

Article 2: Definitions

The following words and expressions, wherever stated herein, shall have the meanings given to them below unless the context implies otherwise:

Law: The applicable Engineers Association Law.
Association: Engineers Association.
Board: The Association Board.
Fund: The Social Security Fund established by virtue of the provisions hereof.
Fund member: A Jordanian Association member
Committee: The Fund Management Committee formed by virtue of the provisions hereof.
Salary: The monthly proceeds disbursed by the Fund to its members of beneficiaries of their family members in accordance with the provisions hereof.
Social Security contributions: The amount to which the Fund member is committed to pay to the Fund under the provisions hereof.
Medical Committee: The Medical Committee approved by the Board.

Article 3: Fund objectives

A Fund shall be established at the Association and named “Social Security Fund” aiming at providing social security to the Association members and beneficiaries of the family members.

Article 4: Fund Management Committee

  1. The Fund shall be managed by the Board and for this purpose, a committee named “Fund Management Committee” shall be formed and headed by the Engineers Association President and membered by:
    1. Engineers Association Vice President.
    2. Association’s Treasurer.
    3. Eight members of the Association appointed by the Board.
  2. The Committee shall take on the matters pertinent to the Fund and submissions in relation thereto to the Board including:
    1. Making the administrative, financial and investment plans of the Fund.
    2. Drafting the annual budget of the Fund.
    3. Making the annual report of the Fund operations and submitting the same to the Board.
    4. Suggesting the amendment of the provisions hereof including the social security contribution amount.
    5. Making the instructions necessary to enforce the provisions hereof.
  3. Upon an invitation made by its Head of Deputy Head when the former is absent, the Committee shall meet once a month. The meeting will be quorate by the presence of at least six of its members including the Head or Deputy Head. The Committee makes its resolution unanimously or by the majority of the votes of its attending members; and if the votes are tied, the meeting chairperson shall have a casting vote.
  4. The Committee term will be the same as the Board term.

Article 5: Fund Executive Manager

The Board shall appoint a Fund Executive Manager to supervise the financial and administrative affairs of the Fund and to attend the Committee meetings without having a voting right.

Article 6: Fund contributions

The Fund member shall pay the Social Security Fund contributions of JOD 30 per year on the annual fees due date, and the failure to pay such contributions is subject to the same legal consequences of the failure to pay the annual fees.

Article 7: Fund’s money investment

  1. The Fund’s money shall be kept and invested as may be decided by the Board in accordance with the Islamic Sharia provisions.
  2. The Board shall conduct an actuarial study of the Fund’s financial position at most every three years.

Article 8: Financial year

  1. The Fund’s financial year shall being on the 1st day of January of each year and shall end on the end of the 31st day of December of the same year.
  2. The Board shall submit the concluding account of the ended financial year to the Central Body of the Association for approval.
  3. The Board shall discuss the Fund’s draft budget of the next financial year; and after it has been approved, it shall present to the Central Body of the Association for approval.
  4. The Board shall provide the Central Body with an annual report of the Fund operations.
  5. If exceptional circumstances prevent the Association Central Body meeting on the date set for the approval of the concluding account and draft budget, the Board shall continue to collect the Fund’s money and spend from them based on the ended financial year budget until the Central Body meets and approves the new budget.

Article 9: Fund member’s rights

  1. The Fund member shall be paid a monthly salary of JOD 100 in any of the following cases:
    1. If, before reaching the retirement age, the Fund member suffers a full permanent disability forcing him to leave the work based on a medical report issued by the Medical Committee.
    2. If, before reaching the retirement age, the Fund member suffers a full temporary disability based on a medical report issued by the Medical Committee, provided that he provides the Committee every six months with medical reports of his health situation acceptable for the Medical Committee, and the salary disbursement will be stopped when the injury effect is over.
    3. If, before reaching the retirement age, the Fund member stops practicing the occupation due to a forcible circumstance in which the Board is convinced, and the salary will be stopped when the effect of such circumstance is over.
  2. The salary receipt application date is considered the salary due date in the cases stated in Clause A of this Article.

Article 10: Beneficiaries due disbursements

In case of the Fund member’s death, the beneficiaries of his family members shall receive the following:

  1. An immediate financial aid of JOD 5000.
  2. A monthly salary of JOD 200 if he dies before he reaches the retirement date.

Article 11: Fund Beneficiaries prior to Regulation enactment

  1. The beneficiaries of the family members of the Fund member retiring prior to the enactment of this Regulation shall be paid an immediate financial aid of JOD 2000 when the Fund member passes away.
  2. The Fund will cease to collect the social security contributions from the retirees when the provisions hereof are applied.

Article 12: Beneficiaries of the unmarried Fund member’s death

  1. Beneficiaries of the unmarried Fund member’s death:
    1. Parents.
    2. Minor siblings.
    3. Disabled siblings.
  2. Beneficiaries of the married Fund member’s death:
    1. Spouse.
    2. Parents.
    3. Children below 18 years old or those who are still studying in educational institutions until they get their first university degree or become above 25 years old, whichever occurs first.
    4. Unmarried, divorced and widowed unemployed daughters.
    5. Disabled children who are unable to work.
    6. Minor siblings upon a written request made by the Fund member.
    7. Disabled siblings upon a written request made by the Fund member.

Article 13: Salaries and financial aids distribution

  1. The salary and financial aid shall be distributed under the provisions hereof evenly to the beneficiaries stated in Article 12 hereof.
  2. The salary will be redistributed if any of the beneficiaries passes away or no longer meets the entitlement requirements, and the redistribution will be made as follows:
    1. A single beneficiary may not receive more than 75% of the due salary.
    2. The total shares of the parents and siblings do not exceed 25% of the due salary if the Fund member was married.

Article 14: Salary cessation

The salary will cease to be disbursed to:

  1. Spouse or sibling if they get married.
  2. Disabled beneficiary when he is no longer disabled.
  3. Daughter when she gets married, and it will be re-disbursed when she is divorced or widowed.

Article 15: Notification of anything as may affect the rights

The Fund member and beneficiary shall notify the Board of anything that may affect the rights given under the provisions hereof, and the Board shall be entitled to take any action as it may deem appropriate in case of a breach of the provisions hereof.

Article 16: Objections Settlement Committee

  1. The Association General Assembly shall, every three years, elect a committee named “Committee on Settlements of Objections to the Board Resolutions” consisting of seven members and two reserve members other than the Board members. The Committee shall review the objections made to it by the Fund members or the beneficiaries of their family members.
    1. In its first meeting, the Committee elected in accordance with Clause A of this Article shall be headed by its most senior member so as to elect from its members a Head and a Deputy Head.
    2. The Committee on Settlements of Objections to the Board Resolutions shall meet upon an invitation made by its Head or Deputy Head if the former is absent, and it shall make its resolutions unanimously or by the majority of the votes of its attending members. If in case the votes are tied, the Head of the meeting shall have the casting vote.
    1. The Fund member or any of the beneficiaries of his family members shall have the right to object to the Board resolutions made by virtue of the provisions hereof before the Committee on Settlements of Objections to the Board Resolutions within 60 days of the date on which he becomes aware of the resolution subject matter of the objection.
    2. A fee of JOD 5 shall be collected for each objection made by virtue of the provisions of this Regulation.

Article 17: Nullification

The Engineers Association Members Social Security Regulation No. 5 of 1986 shall be nullified.
